Terms of Service

These terms apply when you access or use NexusCast, operated by Heal2 Pty Ltd.

Short version: use NexusCast lawfully, keep your account secure, only upload content you have rights to use, and remember that subscriptions renew until cancelled before the next renewal date.

1. Agreement

These Terms of Service govern your access to and use of NexusCast, including nexuscast.net, NexusCast accounts, software, subscriptions, support, and related services.

NexusCast is operated by Heal2 Pty Ltd. By creating an account, starting a trial or subscription, downloading software, or using NexusCast, you agree to these Terms.

You may join the NexusCast newsletter without creating an account. By submitting a newsletter form, you confirm that the email address is yours or that you have authority to use it, and you agree to receive the communications described at signup until you unsubscribe.

If you use NexusCast for a company, studio, production, school, or other organisation, you confirm that you have authority to accept these Terms on its behalf.

2. NexusCast

NexusCast provides rehearsal, script, voice, avatar, AI scene partner, and related productivity tools for actors, creators, and production workflows.

Features may vary by plan, device, region, account status, platform, internet connection, and third-party service availability. Some features may be experimental, beta, or subject to usage limits.

3. Accounts and security

You must provide accurate account information and keep your account credentials secure. You are responsible for activity that occurs through your account unless the activity was caused by our failure to use reasonable care.

You must not share access in a way that avoids device limits, subscription limits, security controls, or licence restrictions.

Tell us promptly if you believe your account or payment method has been compromised.

4. Trials, subscriptions, and billing

Paid NexusCast plans may be offered monthly or yearly. Yearly plans are billed once per year in advance. Monthly plans are billed monthly in advance.

If a plan includes a trial, billing begins when the trial ends unless you cancel before the trial ends. Trial availability may depend on your account, plan, payment method, region, and previous use.

Subscriptions renew automatically unless cancelled before the next renewal date. You authorise us and our payment processor to charge the payment method linked to your account for subscription fees, taxes, and other applicable charges.

Prices, plan names, features, and billing periods are shown at checkout or in your account. We may change prices or plans in the future, but we will provide notice where required by law.

5. Cancellation

You may cancel a subscription through the billing portal or by contacting support where available. Cancellation stops the next renewal; it does not automatically end access immediately.

If you cancel a monthly subscription, access normally continues until the next monthly renewal date. If you cancel a yearly subscription, access normally continues until the next yearly renewal date.

Cancelling does not automatically create a refund or credit for unused time. Refunds are handled under our Refund Policy and applicable law.

6. Your content

You keep ownership of scripts, recordings, avatar files, prompts, rehearsal materials, and other content you upload or create in NexusCast, subject to any rights owned by others.

You grant us a limited licence to host, process, transmit, display, reproduce, and modify your content only as needed to provide, secure, support, and improve NexusCast and related services.

You must have the rights and permissions needed to upload and use your content in NexusCast, including scripts, voices, likenesses, videos, images, names, performances, and third-party materials.

7. Avatar, voice, and likeness rights

If you upload or generate voice, image, video, or avatar content involving a real person, you are responsible for having the required consent and rights to use that person's voice, image, likeness, performance, and related materials.

You must not use NexusCast to impersonate people deceptively, create non-consensual intimate content, violate publicity or privacy rights, or mislead others about whether content is synthetic or generated.

8. Acceptable use

You must not misuse NexusCast, interfere with the service, reverse engineer protected parts of the software except where lawfully permitted, bypass access controls, overload systems, scrape data, introduce malware, or use NexusCast for unlawful activity.

You must not use NexusCast to harass, exploit, defame, threaten, abuse, discriminate against, or harm others, or to create content that violates applicable law or the rights of another person.

We may suspend or restrict access if we reasonably believe an account is being used in a way that violates these Terms, creates legal risk, harms NexusCast, or affects other users.

9. AI outputs and rehearsal results

AI and rehearsal outputs may be inaccurate, incomplete, delayed, or unsuitable for your intended use. You are responsible for reviewing outputs before relying on them.

NexusCast is a rehearsal and productivity tool. It is not a casting guarantee, employment service, legal adviser, medical adviser, financial adviser, or substitute for professional judgement.

10. Intellectual property

NexusCast, the NexusCast name, website, software, designs, workflows, logos, and related technology are owned by Heal2 Pty Ltd or its licensors and are protected by intellectual property laws.

These Terms do not transfer ownership of NexusCast intellectual property to you. You receive only the rights necessary to use NexusCast under your plan and these Terms.

11. Third-party services

NexusCast may integrate with third-party services for authentication, payments, hosting, analytics, email, AI, speech, media, avatar processing, and other functions.

Third-party services may have their own terms and policies. We are not responsible for third-party services except to the extent required by law.

12. Marketing communications

If you join a mailing list, request tips, download resources, start a trial, or otherwise opt in to marketing, we may send NexusCast tips, product updates, offers, surveys, and related communications.

Marketing emails will include an unsubscribe option where required. Unsubscribing from marketing does not stop transactional or service messages about your account, subscription, billing, security, support, or important product changes.

13. Service changes and availability

We may update, improve, limit, suspend, discontinue, or replace parts of NexusCast. We try to avoid unnecessary disruption but cannot guarantee uninterrupted or error-free service.

We may perform maintenance, address security issues, or respond to events outside our reasonable control.

14. Consumer law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, warranty, right, or remedy that cannot lawfully be excluded, restricted, or modified, including under the Australian Consumer Law.

Where we are allowed to limit remedies, our liability is limited to supplying the service again or paying the cost of having the service supplied again.

15. Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of profit, revenue, goodwill, data, opportunity, production time, or business interruption.

Your use of NexusCast is at your own risk, subject to rights and guarantees that cannot be excluded by law.

16. Termination

You may stop using NexusCast at any time. We may suspend or terminate access if you materially breach these Terms, create legal or security risk, fail to pay amounts when due, or misuse the service.

After termination, some provisions continue to apply, including provisions about payment, content rights needed for prior operation of the service, intellectual property, disclaimers, liability, and dispute handling.

17. Governing law

These Terms are governed by the laws of Australia and, where applicable, the laws of the state or territory in which Heal2 Pty Ltd operates, without limiting rights you may have under consumer protection laws in your location.

18. Changes to these Terms

We may update these Terms when NexusCast, our providers, legal obligations, or business practices change. The updated Terms will be posted at nexuscast.net/terms with a new last updated date.

If changes are material, we will take reasonable steps to notify affected users where required.
